After the events of Sept. 11, 2001, the United States Congress passed “The Public Health Security and Bioterrorism Preparedness and Response Act of 2002 (The Bioterrorism Act 2002), which the President signed into law June 12, 2002.
THE NEW LAW REQUIRES THAT
¨ FACILITY REGISTRATION:
Domestic or foreign facilities that manufacture/process, pack, or hold FOOD for human or animal consumption in the US must register with the FDA by December 12th, 2003.
¨ PRIOR NOTICE OF SHIPMENT FOR FOREIGN FACILITIES
Beginning on December 12th, 2003, prior notice must be provided to FDA in advance of an imported food's arrival to the United States.
¨ US AGENT
All foreign facilities must have an US. agent, who must resides or maintains a place of business in the US. and is physically present in the US
